These Terms of Service explain the rules that apply when you visit, use or purchase from nuvinahome.com.

Nuvina is operated by Seyyedarshia Banihashemi, trading as Nuvina. In these Terms, “Nuvina”, “we”, “us” and “our” refer to Seyyedarshia Banihashemi trading as Nuvina.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to customers.

By accessing our website, creating an account or placing an order, you agree to these Terms and the policies referred to within them. Nothing in these Terms removes or limits your rights under applicable UK consumer law.

1. Eligibility and customer accounts

You must be at least 18 years old to place an order, or place the order with the permission and assistance of a parent or legal guardian.

You agree to provide information that is accurate, complete and current when creating an account, placing an order or contacting us.

You are responsible for keeping your account login information secure. Please notify us promptly if you believe your account has been accessed without permission.

You may not sell, transfer or allow another person to misuse your customer account.

2. Products and product information

We aim to ensure that product descriptions, photographs, specifications, prices and availability are accurate.

Product colours may appear slightly different depending on your screen, device settings and lighting. Minor screen differences do not affect your rights where a product is materially different from its description.

Product measurements may contain small reasonable variations where stated.

We may update product information, discontinue products or limit quantities available for purchase.

All products supplied must still comply with the description provided and your applicable statutory rights.

3. Orders and contract formation

Placing an order is an offer to purchase products from Nuvina.

After you place an order, you will normally receive an automatic order-confirmation email. This confirms that we have received your order, but does not necessarily mean that the order has been accepted.

A contract is formed when we confirm that the order has been accepted or dispatched.

We may decline or cancel an order before dispatch where:

  • The product is unavailable
  • Payment cannot be authorised
  • The price or product information contains a clear error
  • We reasonably suspect fraud or unauthorised activity
  • Delivery cannot be completed to the address provided
  • The order breaches these Terms or applicable law

If we cancel an order after payment has been taken, we will issue a refund to the original payment method.

Products purchased through Nuvina are intended for personal or household use unless otherwise agreed.

4. Prices and payment

All prices are displayed in British pounds sterling (GBP).

The price charged will be the price displayed at checkout when the order is placed, subject to correction of obvious errors before the order is accepted.

Free standard UK shipping is included on eligible orders in accordance with our Shipping Policy.

Available payment methods may include Shopify Payments, Visa, Mastercard, American Express, Apple Pay, Google Pay and PayPal where activated.

You confirm that:

  • You are authorised to use the payment method provided
  • The billing information supplied is accurate
  • Sufficient funds or credit are available
  • The payment is not fraudulent or unauthorised

Payments may be processed by third-party payment providers under their own terms and privacy policies.

5. Promotions and discount codes

Promotions, discount codes and special offers may be subject to separate conditions.

Unless stated otherwise:

  • Discount codes cannot be exchanged for cash
  • Only one discount code may be used per order
  • Codes may have an expiry date
  • Codes may exclude selected products
  • Discounts cannot normally be applied retrospectively

We may withdraw or correct a promotion where it contains a clear error, has expired or is being misused.

6. Shipping and delivery

We currently deliver within the United Kingdom only.

Our standard estimated timings are:

  • Processing time: 1–3 business days
  • Estimated total delivery time: 4–11 business days
  • Processing days: Monday to Friday, excluding UK bank holidays

Orders containing multiple products may arrive in separate parcels.

Delivery times are estimates and may occasionally be affected by severe weather, carrier disruption, unusually high order volumes or other events outside our reasonable control.

We will remain responsible for the order until it is delivered to you, or to another person identified by you to receive it.

7. Delivery information supplied by customers

You are responsible for checking that the name, delivery address, postcode, email address and telephone number entered during checkout are correct.

Requests to change an address should be submitted within 24 hours of ordering.

We will try to accommodate changes, but cannot guarantee that an order can be amended once processing or dispatch has begun.

Please contact us promptly if you notice an error.

8. Cancellations

You may request an order cancellation within 24 hours of placing the order.

We will make reasonable efforts to cancel it, but cancellation cannot be guaranteed once the order has entered processing or has been dispatched.

If the order has already been dispatched, you may use the return process after delivery.

This operational cancellation window does not remove any statutory cancellation rights available to UK customers.

9. Returns and refunds

Returns, refunds and faulty-product claims are handled in accordance with our Return and Refund Policy.

Nuvina offers a 30-day return-request window.

For change-of-mind returns:

  • The customer pays the actual return delivery cost
  • Items should be unused and in a resalable condition
  • All included parts and accessories should be returned
  • Original packaging should be included where reasonably possible
  • No restocking fee is charged

For damaged, faulty, incorrect or misdescribed products, Nuvina will provide an appropriate resolution and cover reasonable return costs where applicable.

We do not currently offer direct exchanges.

Nothing in these Terms or our policies limits your rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations. Online customers generally have at least 14 days after receiving goods to notify the seller that they wish to cancel, followed by another 14 days to return them.

10. Errors and availability

Occasionally, our website may contain an error relating to:

  • Product descriptions
  • Prices
  • Promotions
  • Availability
  • Delivery information
  • Images or specifications

We may correct an error at any time.

If a material error is discovered after you order but before acceptance, we may contact you and offer the choice of continuing with the corrected information or cancelling for a full refund.

We will not substitute a materially different product without your agreement.

11. Acceptable website use

You may use the website only for lawful personal purposes.

You must not:

  • Use the website fraudulently or unlawfully
  • Attempt to access another customer’s account
  • Introduce viruses or malicious software
  • Interfere with the website’s operation or security
  • Collect personal information about other users
  • Copy or commercially exploit website material without permission
  • Use automated tools in a way that damages, overloads or disrupts the website
  • Submit false, defamatory, abusive or infringing content
  • Misrepresent your identity or payment authority

We may restrict or suspend access where we reasonably believe these Terms have been breached.

12. Intellectual property

Unless otherwise stated, website branding, layout, written content and original materials are owned by or licensed to Nuvina.

Product names, trademarks, logos and materials belonging to third parties remain the property of their respective owners.

You may access the website for personal, non-commercial use. You may not reproduce, distribute, sell, publish or commercially exploit protected website material without permission from the relevant rights holder.

Nothing in these Terms transfers ownership of intellectual property to customers.

Important: this clause does not make copied images or descriptions legally yours. Only claim ownership of material you created or have permission to use.

13. Reviews, feedback and communications

Where we allow reviews or feedback, you confirm that:

  • Your submission is genuine
  • It reflects your own experience
  • It does not violate another person’s rights
  • It is not unlawful, defamatory or misleading
  • Any incentive or compensation has been clearly disclosed

You grant Nuvina permission to display and use submitted feedback for operating and promoting the store.

We may remove feedback that is unlawful, fraudulent, abusive, irrelevant or infringes another person’s rights.

14. Third-party tools and links

Our website may contain integrations, tools or links provided by third parties.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for the content or operation of unrelated third-party websites.

This does not affect Nuvina’s responsibilities concerning products purchased directly from our store.

15. Relationship with Shopify

Nuvina’s store is powered by Shopify.

Purchases made through the store are contracts between the customer and Nuvina, not Shopify.

Shopify provides the ecommerce technology but is not the seller of Nuvina products and is not responsible for fulfilling customer orders, handling returns or resolving product complaints.

16. Privacy

Personal information is handled in accordance with our Privacy Policy.

Shopify and other service providers may process personal information to provide hosting, payments, fraud prevention, fulfilment, delivery and related services.

17. Service availability

We aim to keep the website available and secure, but cannot guarantee that access will always be uninterrupted or error-free.

We may temporarily suspend access for maintenance, security updates, technical problems or events outside our reasonable control.

We will take reasonable steps to restore service where possible.

18. Liability and statutory rights

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Faulty or misdescribed goods
  • Breach of statutory consumer rights
  • Any other liability that cannot legally be excluded

Where permitted by law, Nuvina is responsible for losses that are a foreseeable result of our breach of these Terms.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products are supplied for private and domestic use. We are not responsible for business losses, lost profits or commercial interruption arising from consumer use of the products.

Your statutory rights remain unaffected.

19. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, widespread carrier disruption, natural disasters, industrial action, government restrictions or major technical failures.

Where such an event affects your order, we will take reasonable steps to contact you and minimise the delay.

Your legal rights concerning significantly delayed or undelivered orders remain unaffected.

20. Ending access

We may suspend or end access to a customer account where we reasonably believe that:

  • The account has been used fraudulently
  • These Terms have been materially breached
  • The website or another user is being harmed
  • Suspension is required by law or for security reasons

Ending website access does not remove obligations relating to orders already accepted, refunds owed or statutory rights.

21. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

22. No waiver

If we do not immediately enforce a right under these Terms, that does not mean that we have waived that right.

23. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer residing elsewhere in the United Kingdom, you continue to benefit from any mandatory protections provided by the laws of the country in which you live and may use courts that have jurisdiction over your consumer claim.

24. Changes to these Terms

We may update these Terms where necessary to reflect changes to our services, policies, technology or legal obligations.

Changes will be published on this page with an updated revision date.

Changes will not unfairly remove rights relating to orders already accepted.
